Uneven and unreliable temperatures

This refrigerator was delivered to me about 2 months ago. Shortly thereafter I began monitoring the temperatures within the refrigerator compartment and the freezer compartment. Even though I set the unit on the very lowest option for each compartment (33F for refrigerator, 0F for freezer), the unit was not achieving those temperatures (or even close to those temperatures) to my satisfaction. I know the settings are only approximate, but the actual temperatures should at least be close. The top part of the refrigerator compartment never reaches below 44-45 degrees F. The bottom shelf hangs around 37-38. (Yes, I know that is within an acceptable range for refrigerated food--but these temps are not close to matching what is expected by the setting.) The freezer is always "ok," but fluctuates from below -2F to as high as 8 F. The drawers in the refrigerator actually do achieve low temperatures consistent with the 33F setting--maybe they trap the cold air. Mind you, all of this is with "pampering" the situation--i.e., checking the temp only at times when the unit has been closed for a significant time (like first thing in the morning), not putting warm things in the refrigerator, etc. I've had three appointments where certified Whirlpool technicians have come out and either replaced a part or poked around and found some frost to knock off inside a blower vent, hoping that was the problem. However, the problem persists. I have contacted my vendor and explained that I am not interested in scheduling any more technician visits and that I want to return/trade my refrigerator. She told me she contacted Whirlpool and I am waiting to hear. That was two days ago, so we'll see if we can work this out.
